These General Terms & Conditions apply to all orders placed with Mallow & Crumble, a business based in the Netherlands and specialized in handmade, fresh, and perishable treats.

By placing an order through our website, you agree to these terms.

1. Ordering

1.1 Orders can be placed online through our webshop.
1.2 All orders are subject to availability.
1.3 You are responsible for providing accurate contact and delivery information. Incorrect details may result in delays or failed delivery for which we cannot be held responsible.
1.4 Once your order is confirmed, you will receive an order confirmation by email.

2. Products

2.1 All our products are handmade and fresh. As a result, variations in appearance, size, or color may occur.
2.2 Because our products are perishable, they must be stored and consumed according to the instructions provided on the product page or packaging.

2.3 All allergen and ingredient information for cookies is available on our website.

2.4 For local delivery, only allergen information is provided on our website.

2.5Consumers are responsible for checking ingredient/allergen information before ordering.

3. Prices

3.1 All prices on our website are shown in euros (€) and include VAT.
3.2 Prices may change at any time, but confirmed orders will not be affected.
3.3 Any obvious errors or misprints in prices do not bind Mallow & Crumble.

4. Payment

4.1 Payments must be completed at checkout. We currently accept:

  • iDEAL

  • Credit & Debit Card payments

  • Google Pay

4.2 Your order will only be processed once payment is successfully completed.

5. Delivery & Shipping

5.1 We offer two delivery options:

  • Shipping within the Netherlands

  • Local Delivery (same-day)

5.2 Delivery times shown on the website are indicative.
5.3 Once your order is handed over to the courier, the risk of delay caused by the carrier lies with the customer.
5.4 If you are not present at the provided address during delivery, we cannot guarantee re-delivery and additional costs may apply.

6. Returns & Refunds (Perishable Products)

6.1 Due to the nature of our products (fresh and perishable), returns and exchanges are not possible. This follows Dutch and EU law (Art. 6:230p BW).

6.2 You may be eligible for a replacement or refund only in the following cases:

  • You received the wrong product.

  • Your order is incomplete.

  • The product is damaged upon delivery.

6.3 In such cases, you must contact us within 24 hours of receiving your order, including clear photos.
6.4 If a refund is approved, it will be issued to the original payment method.

7. Privacy & Data Protection

Our webshop is hosted on the Shopify platform. Shopify manages the technical operation of the webshop and processes personal data on behalf of Mallow & Crumble. Shopify may also process certain data independently to provide platform services, such as security, performance, and personalized features.
Data may be processed outside the European Economic Area (EEA), but Shopify implements GDPR-compliant measures, including standard contractual clauses. More information on Shopify’s data processing and your rights can be found at Shopify Consumer Privacy Policy and Privacy Controls 

7.1 We process your personal data to complete your order.

7.2 We may share data with third parties necessary for processing:

  • Payment providers (e.g. iDEAL, card processors, Google Pay)

  • Our delivery partners (e.g. PostNL)

  • Our webshop platform (Shopify)

7.3 We do not share your data with third parties for marketing without your consent.

8. Liability

8.1 Mallow & Crumble is not liable for:

  • delays caused by the carrier,

  • incorrect handling or storage of products by the customer,

  • damage caused by incorrect or incomplete information provided by the customer.

8.2 Our total liability is limited to the amount paid for the order.

9. Force Majeure

9.1 In case of events outside our control (e.g., extreme weather, delivery disruptions, illness, technical failures), we may suspend or cancel the order.
9.2 In such cases, you will be refunded if payment has already been made.

10. Applicable Law

10.1 Dutch law applies to all agreements made with Mallow & Crumble.
10.2 Disputes will be resolved by the competent court in the Netherlands.
